5) DATA PROCESSING WHEN OPENING A CUSTOMER ACCOUNT AND FOR THE PROCESSING OF CONTRACTS.
In accordance with Art. 6 Para. 1 lit. b GDPR, personal data is collected and processed if you provide it to us for the fulfilment of a contract or when opening a customer account. The data collected can be seen in the respective input forms. You can delete your customer account at any time by sending a message to the above address of the controller. We store and use the data you provide for the execution of contracts. - Right to restriction of processing in accordance with Art. 18 GDPR: You have the right to request the restriction of the processing of your personal data as long as the correctness of your data, which you dispute, is verified, if you refuse the deletion of your data due to unlawful processing and instead request the restriction of the use of your data if you require your data for the establishment, exercise or defence of legal claims in court after we no longer need it for the purposes pursued, or if you have objected to processing for reasons arising from your particular situation, as long as it has not yet been decided whether our legitimate reasons outweigh your reasons.
- Right to information in accordance with Art. 19 GDPR: If you have asserted your right to correction, deletion or restriction of processing, we are obliged to inform all recipients to whom your personal data has been disclosed about this correction or deletion of the data or restriction of processing, unless this proves to be impossible or involves a disproportionate effort. You have the right to be informed about these recipients.
- Right to data portability in accordance with Art. 20 GDPR: You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller, where technically feasible.
- Right to revoke consent granted pursuant to Art. 7 (3) GDPR: You have the right to revoke your consent to data processing at any time with effect for the future. In the event of revocation, we will immediately delete the data concerned unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
- Right to lodge a complaint in accordance with Article 77 of the GDPR: If you believe that the processing of personal data concerning you infringes the GDPR, you have the right, without prejudice to any other administrative or judicial remedy, to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement.
13.2 RIGHT TO OBJECT
IF WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST IN THE CONTEXT OF A BALANCING OF INTERESTS, YOU HAVE THE RIGHT TO OBJECT TO THIS PROCESSING AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION, WITH EFFECT FOR THE FUTURE.
IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE RELEVANT DATA. HOWEVER, WE RESERVE THE RIGHT TO CONTINUE PROCESSING IF WE CAN DEMONSTRATE THAT THERE ARE COMPELLING AND PROTECTION WORTHY REASONS FOR PROCESSING THAT OUTWEIGH YOUR INTERESTS INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR FOR THE ESTABLISHMENT, ASSERTION, EXERCISE OR DEFENCE OF LEGAL CLAIMS.
IF WE PROCESS YOUR PERSONAL DATA FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH MARKETING. YOU CAN EXERCISE YOUR RIGHT TO OBJECT AS DESCRIBED ABOVE.
IF YOU EXERCISE YOUR RIGHT OF OBJECTION, WE WILL NO LONGER PROCESS THE DATA CONCERNED FOR THE PURPOSES OF DIRECT MARKETING.
- STORAGE PERIOD FOR PERSONAL DATA
The duration of the storage of personal data is based on the respective statutory retention period (e.g. tax and commercial law retention periods). After the deadline has passed, the corresponding data is routinely deleted, unless it is required for the fulfilment of the contract or the initiation of a contract and/or there is a legitimate interest in further storage on our part.
